Terms of Service

These Terms of Service ("Terms") govern your access to and use of all services provided by Kosmo's12 Inc. ("Company"), including the company website and the mobile game Dynamite Blue.

[ ART. 01 ]Article 1. Purpose

These Terms govern the rights, obligations, and responsibilities between Kosmo's12 Inc. ("Company") and users with respect to the use of the company website (kosmos12.com and its subdomains), the mobile game "Dynamite Blue", and any related online or offline services (collectively, the "Services").

[ ART. 02 ]Article 2. Definitions

The terms used in these Terms are defined as follows.

  1. "Services" means the company website, the mobile game Dynamite Blue, ancillary services, and all related content provided by the Company.
  2. "User" means any member or non-member who accesses the Services in accordance with these Terms.
  3. "Member" means a person who has agreed to these Terms and entered into a service agreement with the Company.
  4. "Account" means the identification information assigned to a Member by the Company for identification and use of the Services.
  5. "Content" means all materials provided through the Services, including game characters, illustrations, music, text, images, and videos.
  6. "Game Data" means data generated through gameplay, including level, character ownership, play history, and payment records.

[ ART. 03 ]Article 3. Effect and Modification of Terms

  1. These Terms become effective when posted within the Services or otherwise made available to Users.
  2. The Company may amend these Terms within the scope permitted by applicable laws, including the Act on the Regulation of Terms and Conditions, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Game Industry Promotion Act, and the Content Industry Promotion Act.
  3. If these Terms are amended, the Company will announce the effective date and reason at least 7 days in advance through the Services. For changes unfavorable to Users, the Company will give notice at least 30 days in advance and notify Users individually through reasonable means.
  4. If a User does not express disagreement before the effective date of the amended Terms, the User is deemed to have agreed to the amendments.

[ ART. 04 ]Article 4. Provision of Services

  1. The Company provides the following Services.
    • Information about the Company and games via the company website
    • The mobile game Dynamite Blue and related content
    • Closed Beta Test (CBT) pre-registration and notifications
    • Events, promotions, and marketing activities
    • Customer support and inquiry response
    • Other services provided by the Company directly or through partnerships
  2. The Services are provided 24 hours a day, 365 days a year in principle. Services may be temporarily suspended for system maintenance, expansion, or replacement.
  3. The Company may modify the content, quality, or operation of the Services and will provide advance notice of such changes.

[ ART. 05 ]Article 5. User Agreement and Account

  1. A user agreement is formed when the User agrees to these Terms, applies for membership through the Company's procedures, and the Company accepts the application.
  2. The Company may refuse acceptance or terminate a service agreement in any of the following cases.
    • The application contains false information or uses another person's identity
    • The application omits required information
    • A child under the age of 14 applies without consent of a legal guardian
    • The applicant has previously had service access restricted or terminated
    • The application otherwise violates these Terms or applicable laws
  3. Users are responsible for safely managing their Account credentials. The Company is not responsible for damages caused by leakage, transfer, or rental of Account information.

[ ART. 06 ]Article 6. Company's Obligations

  1. The Company shall not engage in conduct prohibited by applicable laws or these Terms or contrary to public morals, and shall make ongoing efforts to provide the Services in a stable manner.
  2. The Company shall maintain a security system to protect personal information (including credit information) and shall publish and comply with its Privacy Policy.
  3. The Company shall not disclose or distribute Users' personal information to third parties without consent, except where required by law.
  4. The Company shall make reasonable efforts to promptly handle legitimate opinions or complaints from Users.

[ ART. 07 ]Article 7. User's Obligations

Users shall not engage in any of the following conduct.

  1. Registering false information when applying or making changes
  2. Impersonating another person or misappropriating another person's information, account, or payment method
  3. Infringing the intellectual property rights of the Company or third parties
  4. Damaging the reputation or interfering with the business of the Company or third parties
  5. Disclosing or posting obscene, violent, or otherwise indecent content within the Services
  6. Using automated tools, hacks, macros, bots, or other unauthorized methods to access or use the Services
  7. Buying, selling, or attempting to trade in-game currency, items, or accounts for cash or other economic benefit
  8. Using unauthorized clients or modified software not provided by the Company
  9. Any other conduct that violates applicable laws, these Terms, service guidelines, or operational policies

[ ART. 08 ]Article 8. User Content

  1. The copyright in any content posted by a User within the Services belongs to the User.
  2. The Company is granted a worldwide, royalty-free license to use, display, promote, and improve the Services using such content.
  3. The Company may delete, move, or refuse to register the following content without prior notice.
    • Content that defames or damages the reputation of others
    • Content that violates public order or morals
    • Content associated with criminal activity
    • Content that infringes third-party intellectual property rights
    • Content that violates applicable laws or Company policies

[ ART. 09 ]Article 9. Intellectual Property

  1. The copyright and other intellectual property rights in the Services and all related content (game characters, illustrations, music, video, text, design, trademarks, code, etc.) belong to the Company or its rightful owners.
  2. Users shall not, without the prior written consent of the Company or the rights holder, reproduce, transmit, publish, distribute, broadcast, or otherwise commercially exploit any information obtained through the Services in which the Company or its providers hold intellectual property rights.
  3. The use of derivative works (fan art, videos, doujinshi, etc.) created by Users while using the Services is governed by separate guidelines published by the Company.

[ ART. 10 ]Article 10. Paid Services and Payment

  1. The Company may provide certain in-game content as paid Services. The types, prices, and payment methods will be displayed within the Services.
  2. Users may use paid Services through payment methods provided by the Company (App Store payment, Google payment, credit card, mobile carrier billing, etc.).
  3. Use of paid Services is also subject to the policies of payment processors and platform providers (Apple, Google, etc.).
  4. If a minor makes a purchase without consent of a legal guardian, the minor or the guardian may cancel the purchase.

[ ART. 11 ]Article 11. Withdrawal of Subscription and Refund

  1. Users who have purchased paid Services may withdraw their subscription within 7 days from the date of payment, in accordance with the Act on the Consumer Protection in Electronic Commerce and the Content Industry Promotion Act.
  2. Withdrawal of subscription may be limited in the following cases.
    • Goods or services that are consumed or applied immediately upon purchase have already been used
    • The value of the goods has been substantially reduced through use or partial consumption
    • Part of a divisible item has been consumed (refund limited to the unused portion)
    • Other cases where withdrawal is restricted under applicable law
  3. Refunds will be processed using the original payment method, and processing time may vary depending on the payment processor and platform provider policies.

[ ART. 12 ]Article 12. Service Use Restrictions

  1. If a User violates these Terms or operational policies or interferes with the normal operation of the Services, the Company may restrict service use in stages, including warning, temporary suspension, and permanent suspension.
  2. For serious violations (use of automation programs, payment fraud, account trading, system intrusion, etc.), the Company may impose permanent suspension without prior notice.
  3. Users may file an objection to a use restriction in accordance with the procedures established by the Company.

[ ART. 13 ]Article 13. Termination

  1. Users may terminate the service agreement at any time through the in-service account deletion feature or by contacting customer support.
  2. Upon termination, the Company will destroy the User's personal information in accordance with the Privacy Policy. Information required to be retained by law will be retained for the applicable period.
  3. Upon termination, all in-game currency, items, and characters held by the User will be forfeited and not refunded (unused payment amounts are subject to the separate refund policy).

[ ART. 14 ]Article 14. Disclaimer

  1. The Company is exempt from liability for failure to provide the Services due to force majeure, including natural disasters, war, riots, communication outages, and power failures.
  2. The Company is not liable for service disruptions caused by the User's fault.
  3. The Company is not liable for any expected revenue that the User fails to obtain or any losses incurred from materials obtained through the Services.
  4. The Company has no obligation to intervene in disputes between Users or between Users and third parties arising from use of the Services and is not liable for any resulting damages.

[ ART. 15 ]Article 15. Disputes and Governing Law

  1. The Company and Users shall make all reasonable efforts to amicably resolve disputes arising from use of the Services.
  2. These Terms shall be governed by and interpreted under the laws of the Republic of Korea.
  3. Any litigation arising from use of the Services shall be brought before the competent court designated under the Civil Procedure Act of Korea.
